Marcelo is in charge of the Energy and Regulated Markets area. He has focused his professional practice on various aspects of economic regulation, particularly in the field of energy law, occupying various positions in both the private and public sectors. In such positions, he has advised important national and foreign companies in multiple regulatory and contractual aspects related to the development, operation and closing of projects in the energy (electricity, oil and geothermal energy) and mining industries, as well as other sectors.

In the public sector, Marcelo has worked as an attorney for the Ministries of Mining and Energy, and as the head attorney (Chief Legal Officer) of the latter. In the private sector, he has worked as a senior and area director in the firms Núñez, Muñoz y Cia; Aylwin, Mendoza, Luksic y Valencia Abogados; Correa-Gubbins, and Jara del Favero Abogados.

  • Representing power generation companies in discrepancy procedures before the Panel of Experts under the General Law on Electrical Services.
  • Counsel for a Spanish company in bidding processes for the expansion of transmission lines.
  • Counsel for the operator of the Norte Grande Power System in the preparation of a study on the institutional framework for power system operators, and subsequently in the drafting of the Internal Regulation of the National Electric Coordinator.
  • Counsel for a power generation company, in the negotiation and execution of connection agreements, in the application process, management and extension of public concessions, and in the negotiation and drafting of several contracts of easement agreements, as well as in the preparation of various reports on energy regulation issues.
  • Counsel for power generation companies in M&A transactions, in the drafting and revisions of the various documents related to those sale processes (shareholders’ agreements, amendments of bylaws, notifications to the CNE, etc.).
  • Counsel for power companies in the constitution of mining property for land protection purposes in relation to the development of NCRE projects.
  • Counsel for power generation company in the financing process for a wind power project.
  • Counsel for an oil company in applications for various oil operations contracts, relations with the authority in connection with such contracts, and the negotiation and creation of oil easements.
  • Counsel for a geothermal generation company in the processing of applications for geothermal concessions, and negotiation of various exploration contracts.
  • Representation of a distribution company in the review of bids during a bidding process launched for power purchase agreements, process 2015/01.
  • Counsel for a construction company in relation to construction services for electrical projects, in disputes with its principal during the execution of expansion works.
  • Counsel for a company in the field of LNG, in relation to antitrust matters.
  • Advising energy companies in due diligence processes and land title studies for several SMGD and SMG projects.
  • Advising power companies in various requests for declarations of force majeure before the Ministry of Energy regarding expansion works.
