Claudio Matute leads the Dispute Resolution group. His practice is focused on civil and commercial litigation, and domestic and international arbitration (CAM Santiago, ICSID and ICC) in several matters, including contractual and tort liability, foreign investment, corporate law, consumer law, unfair competition, distribution contracts, warranties, and environmental law, among others. He is also a member of the roster of arbitrators of CAM Santiago and the Court of Appeals of Santiago.
His practice also includes pre-litigation advisory services to domestic and foreign clients in the mining, energy, foreign investment, international trade, retail, and manufacturing sectors, among others.
Mr. Matute previously worked in the litigation and arbitration areas of Carey y Cía., Santiago (2017-2018) and Bofill Mir & Álvarez Jana, Santiago (2010-2014) (2016-2017), and served as a foreign associate in the international arbitration group of Arnold & Porter LLP, Washington, D.C. (2015-2016).
- To a Spanish construction company, in an international arbitration conducted under the Rules of the International Chamber of Commerce in Paris (ICC), sued for USD 200 million over claims related to alleged delays and improper performance of a cogeneration power plant.
- To a Japanese mining company, sued for USD 50 million in an arbitration. ad hoc relacionado a la construcción de un dump leach en altura en el norte de Chile.
- To a Chilean hydroelectric company, in an international CAM arbitration, sued for more than USD 20 million in a contractual-corporate dispute.
- Counsel for CORFO, in the so-called "CORFO-Inverlink" case, seeking the restitution of funds defrauded against more than 28 investors, totalling over $80 billion.
- Counsel for CODELCO, in a national CAM arbitration against a thermoelectric generator in a dispute related to the execution of an electricity supply contract.
- To a Brazilian power transmission company, in an international arbitration conducted under the Rules of the International Chamber of Commerce in Paris (ICC), sued for USD 30 million in a dispute related to the construction of an electrical substation.
- Counsel for a European State, in six international investment arbitrations related to the introduction of the so-called "solar tax" applicable to solar photovoltaic power generators.
- A Chilean contractor in a national CAM arbitration regarding alleged breaches in the construction of a desalination plant in northern Chile.
- Grupo CAP and its subsidiaries in various pre-litigation, judicial, and arbitration matters related to the steel, desalination, and real estate industries, among others.
- An Irish-owned energy generation company in an arbitration concerning the validity and execution of a Power Purchase Agreement (PPA), with a value exceeding USD 20 million.
- Chile Scholarship (Becas Chile), for master's degree studies abroad (2014).
- Constitutional Tribunal 2012" award for the thesis "Regulatory Takings". Applicability to the Chilean Case," awarded by the Constitutional Court.
